1. ABOUT THE APP

1.1 Welcome to tHe Spring and Design Village web application (the “App”). This App allows us to provide you with information and/or updates on our products, services, upcoming promotions which may interest you from time to time in respect of tHe Spring shopping mall as operated by The Spring Management Services Sdn. Bhd. (“TSMS”) through the App (“Services”).

1.2 As used herein, “You” and “Your” refer to the individual or entity that wishes to use the App. Your license to this App is subject to your prior acceptance of these Terms.

1.3 The App is owned and operated by TSMS. Access to and use of the App, and the Services is provided by TSMS. Please read these terms and conditions (the “Terms”) carefully. If you do not agree with the Terms, you must cease usage of the web App and the Services immediately.

1.4 TSMS reserves all ownership and intellectual property rights in and to the App, including but not limited to the text, graphics, images, data, audio, videos and other material and information (“Content”) within the App.

1.5 TSMS reserves the right to review and change any of the Terms by updating the Terms at its sole discretion. When TSMS updates the Terms, it will use reasonable endeavours to provide you with notices of updates to the Terms. Any changes to the Terms take immediate effect from the date of their publication. TSMS may also make improvements and/or changes in services and functionalities or add new features at any time without notice in respect of the App and/or the Services. We encourage you to periodically read these Terms to see if there have been any changes to our policies that may affect you. Your continued use of this App will signify your continued agreement to these Terms as they may be revised. Before you continue, we recommend you keep a copy of the Terms for your records.

2. ACCEPTANCE OF THE TERMS

2.1 You accept the Terms by clicking to agree to the Terms where this option is made available to you by TSMS in the user interface.

3. ELIGIBILITY AND REGISTRATION TO USE THE SERVICES

3.1 In order to utilize the web App and Services, you must first register for an account through the App (the “Account”). TSMS reserves the right to reject your registration at its sole and absolute discretion without having to provide any reasons.

3.2 You warrant that any information you give to TSMS in the course of completing the account registration process will always be accurate, correct and up to date and you agree to update such information as needed. If you do not, TSMS has the sole and absolute discretion to suspend or terminate your Account.

3.3 Once you have completed the registration process and your registration has been accepted by TSMS, you will be a registered user of the App (“User”) and agree to be bound by the Terms.

4. YOUR OBLIGATIONS AS A USER

4.1 As a User, you agree to comply with the following:

(a) You have the sole responsibility for protecting the confidentiality of your password, login details and/or email address. Use of your password by any other person may result in the immediate suspension or termination of your Account and/or the provision of Services.

(b) Any use of your registration information by any other person, or third parties, is strictly prohibited. You agree to immediately notify TSMS of any unauthorized use of your password, login details and/or email address or any breach of security of which you have become aware.

(c) Access and use of the App is limited for the sole use of the App by you for the purposes of TSMS providing the Services.

(d) You will not use the Services or App in connection with any commercial endeavours except those that are specifically endorsed or approved by TSMS.

(e) You will not use the Services or App for any illegal and/or unauthorized use which includes collecting email addresses of Users by electronic or other means for the purpose of sending unsolicited email or unauthorized framing of or linking to the App.

(f) You agree that commercial advertisements, affiliate links, and other forms of solicitation may be removed from the App without notice and may result in termination of the Services. Appropriate legal action will be taken by TSMS for any illegal or unauthorized use of the App.

(g) You acknowledge and agree that any automated use of the App or its Services is prohibited.

5. CONSENT TO USE OF DATA

5.1 You agree that TSMS may collect, use, store, process, maintain, upload, sync, transmit, share, disclose and use your Personal Data (as defined in the Privacy Policy) that will be derived from the data, information and images you will provide when using tHe Spring App (collectively, “User Data”) to facilitate the provision of the Services or functionality of the App, including but not limited to other services related to the App or to otherwise improve TSMS’s ability to provide other services (if any). You acknowledge that use of the App may result in User Data being transmitted or disclosed to or accessed by TSMS and other third parties in accordance with TSMS’s Privacy Policy, including any transfer of User Data outside of Malaysia.

5.2 By registering as a user, you expressly consent to the foregoing collection, use, storage, processing, maintenance, uploading, syncing, transmitting, sharing, or disclosure of user data.

5.3 By continuing to use the App, you indicate your continued consent to such collection, use, storage, processing maintenance, uploading, syncing, transmitting, sharing, or disclosure of User Data as well as collection, storage, transmission and use of data of the type and in the manner described in TSMS’s Privacy Policy on the App.

6. SECURITY AND CONFIDENTIALITY

6.1 We afford the same degree of confidentiality to the User Data stored on the App as is given to customer information stored by TSMS in any other medium. TSMS is committed to protecting the confidentiality of your information. We limit our employees’ access and ability to enter or view User Data based upon their role in the operation of the App and/or the provision of Services. We have taken steps to make all User Data we receive is as secure as possible against unauthorized access, use, or disclosure.

7. GENERAL DISCLAIMER

7.1 You expressly acknowledge and agree that use of the App and your reliance on the Service provided through the App is at your sole risk and that the entire risk as to satisfactory quality, performance, accuracy is with you. To the maximum extent permitted by applicable law, the App and any services are provided “as is” and “as available”, with all faults and without warranty of any kind, and TSMS hereby disclaims all warranties and conditions with respect to the App and any Services, either express, implied and/or statutory.

7.2 TSMS does not warrant against interference with your enjoyment of the App, that the functions contained in, or Services performed or provided by, the App will meet your requirements, that the operation of the App or Services will be uninterrupted or error-free, or that defects in the App or Services will be corrected. No oral or written information or advice given by TSMS, its authorized representatives, or its partners shall create a warranty.

8. LINKS TO THIRD PARTY APPS

8.1 The App provides links to other mobile applications, or content that are not owned or controlled by TSMS, including TSMS’s partners, sponsors or other providers ("Third Party Providers"). These links are intended to connect you easily to additional sources of retail information or third party services that may be of interest to you. We may not have any business relationship with the Third-Party Provider that controls this type of content and such links are offered only as a convenience to you. TSMS is not responsible for the Content, security, or the privacy practices of Third-Party Providers. Please review the privacy statement and any terms of use of each Third-Party Providers you use. Unless we specifically advise you otherwise, links to Third Party Providers do not constitute or imply endorsement by TSMS of those sites, the information they contain or any products or services they describe.

9. LIMITATION ON LIABILITY

9.1 You expressly understand and agree that TSMS, its affiliates, employees, agents, contributors, contractors and licensors shall not be liable to you, to the fullest extent allowed by law, for any direct, indirect, incidental, special consequential or exemplary damages which may be incurred by you, however caused and under any theory of liability. This shall include, but is not limited to, any loss of benefit and any other intangible loss.

10. PROHIBITED ACTIVITY

10.1 You agree that you will not upload or transmit any Content of any type that infringes upon, misappropriates or violates any rights of any party. In consideration of being allowed to use the App, you agree that the following actions shall constitute a material breach of these Terms:

(a) signing on as or pretending to be another person;

(b) using the App for any purpose in violation of local, state, national, international laws or posted TSMS policies;

(c) transmitting Content that infringes or violates the intellectual property rights of others or the privacy or publicity rights of others;

(d) transmitting Content that is unlawful, obscene, defamatory, predatory of minors, threatening, harassing, abusive, slanderous, or hateful to any person (including TSMS personnel) or entity as determined by TSMS in its sole discretion;

(e) using the Services and/or App in a way that is intended to harm, or a reasonable person would understand would likely result in harm, to yourself or others;

(f) collecting information about others, including e-mail addresses;

(g) intentionally distributing viruses or other harmful computer code; and

(h) TSMS expressly reserves the right, in its sole discretion, to terminate a User's access to the App due to any act delineated above, or any act that would constitute a violation of these Terms.

11. COPYRIGHT AND INTELLECTUAL PROPERTY

11.1 The App, Services and all related products of TSMS are subject to copyright. The Content on the App is protected by copyright under the laws of Malaysia and through international treaties. Unless otherwise indicated, all rights (including copyright) in the Services and compilation of the App (including but not limited to text, graphics, logos, images, button icons, video images, audio clips, code, scripts, design elements and interactive features) or the Services are owned or controlled for these purposes, and are reserved by TSMS or its contributors.

11.2 All trademarks, service marks and trade names are owned, registered, and/or licensed by TSMS, who grants to you a worldwide, non-exclusive, royalty free, revocable license whilst you are a User to:

(a) use the App pursuant to the Terms; and

(b) copy and store Content contained in the App in your Device’s cache memory.

11.3 TSMS retains all rights, title, and interest in and to the App and all related Services. Nothing you do on or in relation to the App will transfer any of the following to you:

(a) business name, trading name, domain name, trade mark, industrial design, patent, registered design or copyright;

(b) a right to use or exploit a business name, trading name, domain name, trade mark, or industrial design; or

(c) a thing, system or process that is the subject of a patent, registered design, or copyright (or an adaptation or modification of such a thing, system or process).

11.4 You may not without the prior written permission of TSMS and the permission of any other relevant rights owners, broadcast, republish, up-load to a third party, transmit, post, distribute, show or play in public, adapt or change in any way the Services, unless otherwise provide by these Terms. This prohibition does not extend to the Content on the App which are freely available for re-use or are in the public domain (if any).

12. COMPETITORS

12.1 If you are in the business of providing similar Services for the purpose of providing them to users for a commercial gain, whether business users or domestic users, then you are a competitor of TSMS. Competitors are not permitted to use or access any Content on our App. If you breach this provision, TSMS will hold you fully responsible for any loss that we may sustain and hold you accountable for all profits that you might make from such breach.

13. INDEMNITY

13.1 You agree to indemnify TSMS, its affiliates, employees, agents, contractors, contributors, and third-party content providers and licensors from and against any breach by you of the Terms.

14. MISCELLANEOUS

14.1 If any provision in the Terms is held by a court of competent jurisdiction to be illegal, invalid or unenforceable in any respect under any applicable law, then such provision shall (so far as it is invalid or unenforceable) be given no effect and shall be deemed not to be included in the Terms but without invalidating any of the remaining provisions of the Terms. Any provision of the Terms held invalid or unenforceable only in part or degree will remain in full force and effect to the extent not held invalid or unenforceable. TSMS shall then use all reasonable endeavours to replace the invalid or unenforceable provision(s) with a valid and enforceable substitute provision the effect of which is as close as possible to the intended effect of the invalid or unenforceable provision.

14.2 In the event you read the Terms in any language other than English, you agree that in the event of any discrepancies, the English language version shall prevail.

1.1 This is the personal data privacy policy (“Policy”) of The Spring Management Services Sdn. Bhd. (“TSMS”, “We”, “Us”, or “Our”).

1.4 By providing your Personal Data to us, registering for an account through the App (“Account”) and/or using the App, you declare that you have read and understood this Policy and agree to TSMS processing your Personal Data in accordance with the manner as set out in this Policy.

Any changes made to this Policy will be posted via the App, on the website of TSMS (“Site”) and or other appropriate means, and where appropriate, notified to you. Any of your Personal Data provided to us is retained for as long as the purposes for which the Personal Data was collected continues; your Personal Data is then destroyed from our records and system in accordance with our retention policy in the event your Personal Data is no longer required for the said purposes unless its further retention is required to satisfy a longer retention period to meet our operational, legal, regulatory, tax or accounting requirements.

13. CONFLICTS

In the event of any conflict between this English language Personal Data Privacy Policy and its corresponding Bahasa Malaysia Personal Data Privacy Policy, the terms in this English language Personal Data Privacy Policy shall prevail.

1. PENGENALAN

1.1 Ini adalah dasar polisi data peribadi (Polisi) The Spring Management Services Sdn. Bhd. (" TSMS ", " Kami "atau " Kita ").

1.2 Polisi ini digunapakai terhadap semua data peribadi (pelanggan, pelawat, vendor, pengedar, pembekal, penyedia perkhidmatan secara kolektif, “Anda” dan “Kamu”) dikumpulkan, digunakan, didedahkan dan / ataupun diproses oleh TSMS tetapi tidak terbatas pada aplikasi laman sesawang (Aplikasi) tHe Spring dan sebarang program penghargaan dan keistimewaan yang dikendalikan oleh TSMS berkenaan dengan pusat membeli-belah tHe Spring melalui Aplikasi (“ Perkhidmatan ”).

1.3 TSMS hanya akan memproses Data Peribadi anda sesuai dengan Undang-Undang Perlindungan Data Peribadi 2010, peraturan, panduan, perintah yang termaktub di bawah Akta Perlindungan Data Peribadi 2010 dan setiap perubahan atau perundangan semula yang dibuat dari Akta Perlindungan Data Peribadi 2010 dari semasa ke semasa (secara kolektif disebut sebagai " PDPA ") dan juga Dasar ini. " Data Peribadi " bermaksud apa-apa maklumat yang dimiliki atau dikawal oleh kami yang berkaitan secara langsung atau tidak langsung dengan individu sejauh mana individu tersebut dapat dikenal pasti atau dapat dikenali dari maklumat tersebut dan maklumat lain yang kami miliki, seperti nama, alamat, nombor telefon, Nombor pengenalan / pasport, tarikh lahir, foto, alamat e-mel, maklumat rumah tangga, dan lain-lain serta Data Peribadi Sensitif seperti yang ditentukan di bawah PDPA, yang merangkumi tetapi tidak terhad kepada, maklumat yang berkaitan dengan kesihatan fizikal atau mental atau data subjek dan agama.

1.4 Dengan memberikan pengenalan Data Peribadi anda kepada kami, mendaftar untuk akaun melalui Aplikasi (" Akaun ") dan / atau menggunakan Aplikasi, anda menyatakan bahawa anda telah membaca dan memahami Dasar ini dan bersetuju untuk TSMS memproses Data Peribadi anda sesuai dengan cara yang dinyatakan dalam Polisi ini.

1.5 TSMS berhak untuk mengubah, mengemas kini dan / atau meminda Polisi ini dari semasa ke semasa. Segala perubahan yang dibuat pada Polisi ini akan diposkan melalui Aplikasi, di laman sesawang TSMS (“ Site ”) dan atau cara lain yang bersesuaian, dan dimana sesuai akan diberitahu kepada anda. Sila periksa Aplikasi dan/atau Laman dari semasa ke semasa untuk melihat apakah terdapat pindaan pada Dasar ini. Sebarang pindaan pada Polisi ini akan berkuat kuasa setelah diberitahu kepada anda. Jika anda terus menggunakan Aplikasi dan/atau Perkhidmatan setelah diberitahu tentang sebarang perubahan pada Dasar ini, anda akan dianggap telah menyetujui dan menerima pindaan tersebut.

1.6 Sekiranya anda tidak bersetuju dengan Polisi ini atau pindaan terhadap Polisi ini, TSMS mungkin tidak dapat memberikan perkhidmatan kepada anda dan anda mungkin diminta untuk menangguhkan atau menghentikan Akaun anda , berhenti mengakses Aplikasi dan/atau menggunakan Perkhidmatan.

2. PENGUMPULAN DATA PERIBADI

2.1 Jenis Data Peribadi yang dikumpulkan bergantung pada tujuan pengumpulan. Kami dapat "memproses" Data Peribadi anda dengan cara mengumpulkan, merakam, memegang, menyimpan, menggunakan dan / atau mengungkapkannya.

2.2 Data Peribadi anda mungkin dikumpulkan dari anda semasa anda berurusan dengan kami dengan cara apa pun termasuk mengikut urus niaga dan/atau komunikasi yang dibuat dari/dengan kami. Kami juga dapat mengumpulkan Data Peribadi anda dari pelbagai sumber, termasuk tanpa batasan, di mana-mana acara, seminar, pertunjukan jalanan(jerayawara), tinjauan kepuasan pelanggan yang diatur dan / atau ditaja oleh kami, serta dari sumber yang tersedia untuk umum. (a) Apabila anda mendaftar butiran anda secara manual dengan kami atau di App atau laman sesawang kami;

(b) Apabila anda menyelesaikan pesanan pembelian, permintaan atau aplikasi untuk produk atau perkhidmatan kami (melalui telefon, secara langsung, mail kiriman pos, atau secara elektronik);

(c) Apabila anda berkomunikasi dengan kami secara langsung melalui pusat khidmat pelanggan kami;

(d) Semasa anda melakukan urus niaga tertentu seperti pembayaran balik;

(e) Semasa anda memasuki, dan semasa anda berinteraksi dengan kami semasa promosi, pertandingan, pertandingan, cabutan bertuah, acara khas , di dalam pusat membeli - belah tHe Spring dan Design Village Mall ;

(f) Mengambil bahagian dalam tinjauan dan jenis penyelidikan lain; atau

(g) Sekiranya anda adalah calon pekerjaan ketika anda mengisi borang yang berkaitan dengan proses pengambilan dan pemilihan untuk tujuan penilaian. Kami juga dapat mengumpulkan maklumat mengenai anda dari individu rujukan yang anda telah calonkan di mana anda telah memberi kami kebenaran untuk melakukannya.

2.3 Di samping itu, kami juga dapat menerima, menyimpan dan memproses Data Peribadi anda yang disediakan atau disediakan oleh pihak ketiga, badan rujukan kredit, pihak penguatkuasaan dan penguatkuasaan undang-undang, dengan sebab termasuk penghantaran produk dan / atau perkhidmatan kami, prestasi syarat perjanjian dan / atau untuk mematuhi tanggungjawab undang-undang dan peraturan kami.

(a) untuk berkomunikasi dengan anda dan mengekalkan dan memperbaiki hubungan dengan pelanggan ;

(b) untuk menilai, memproses dan menyediakan produk, perkhidmatan dan / atau kemudahan kepada anda;

(c) untuk mentadbir dan memproses pembayaran yang berkaitan dengan produk, perkhidmatan dan / atau kemudahan yang diminta oleh anda;

(d) untuk membuktikan identiti dan latar belakang anda;

(e) untuk menjawab pertanyaan atau aduan anda dan menyelesaikan sebarang masalah dan pertikaian yang mungkin timbul berkaitan dengan sebarang urusan dengan kami;

(f) untuk memberi anda maklumat dan / atau kemas kini mengenai produk, perkhidmatan kami, promosi akan datang yang ditawarkan oleh kami dan / atau acara yang dianjurkan oleh kami dan pihak ketiga terpilih yang mungkin menarik bagi anda dari semasa ke semasa;

(g) untuk tujuan pemasaran langsung melalui SMS, panggilan telefon, e-mel, faks, mel, media sosial dan / atau saluran komunikasi lain yang sesuai kepada anggota program kesetiaan kami ;

(h) untuk memudahkan penyertaan anda dalam, dan pentadbiran kami, dalam setiap acara termasuk pertandingan, promosi atau kempen;

(i) untuk memberikan mata dalam program kesetiaan atau penghargaan;

(j) untuk mengekalkan dan mengemas kini penyimpanan rekod dalaman;

(k) untuk tujuan pentadbiran dalaman;

(l) untuk menghantar mesej ucapan bermusim dari semasa ke semasa;

(m) untuk menghantar jemputan kepada anda untuk menyertai acara dan promosi serta acara pelancaran produk kami;

(n) untuk memantau, mengkaji dan memperbaiki acara dan promosi, produk dan / atau perkhidmatan kami;

(o) untuk melakukan pemeriksaan rujukan kredit dan menentukan kelayakan kredit anda, jika perlu, dalam menyediakan produk, perkhidmatan dan / atau kemudahan kepada anda;

(p) untuk mentadbir dan melaksanakan urus niaga komersial anda dengan kami (seperti pemberian tender, kontrak untuk perkhidmatan, perjanjian penyewaan);

(q) untuk memproses dan menganalisis Data Peribadi anda sama ada secara individu atau bersama dengan individu lain ;

(r) untuk melakukan penyelidikan atau tinjauan pasaran, analisis pemasaran dalaman, aktiviti profil pelanggan, analisis corak dan pilihan pelanggan, perancangan dan analisis statistik dan trend berkaitan dengan produk dan / atau perkhidmatan kami;

(s) untuk berkongsi mana-mana Data Peribadi anda dengan juruaudit untuk tujuan audit dalaman dan laporan kami;

(t) untuk berkongsi mana-mana Data Peribadi anda menurut perjanjian atau dokumen yang telah anda masukkan dengan kami untuk tujuan mendapatkan nasihat undang-undang dan / atau kewangan dan / atau untuk tujuan memulakan tindakan undang-undang;

(u) untuk berkongsi mana-mana Data Peribadi anda dengan usaha sama / rakan kongsi perniagaan kami untuk bersama-sama mengembangkan produk dan / atau perkhidmatan atau melancarkan kempen pemasaran;

(v) untuk berkongsi mana-mana Data Peribadi anda dengan syarikat insurans yang diperlukan untuk tujuan menerapkan dan mendapatkan polisi insurans, jika perlu;

(w) untuk berkongsi mana-mana Data Peribadi anda dengan institusi kewangan yang diperlukan untuk tujuan memohon dan mendapatkan kemudahan kredit, jika perlu;

(x) untuk tujuan audit, pengurusan risiko dan keselamatan;

(y) untuk mengesan, menyiasat dan mencegah aktiviti penipuan, larangan atau haram;

(z) untuk membolehkan kami melaksanakan kewajipan kami dan menegakkan hak kami di bawah sebarang perjanjian atau dokumen yang melibatkan pihak kami;

(aa) untuk memindahkan atau menyerahkan hak, kepentingan dan kewajiban kami berdasarkan perjanjian yang dimeterai dengan kami;

(bb) untuk memenuhi segala persyaratan hukum atau peraturan yang berlaku dan membuat pengungkapan di bawah kehendak undang-undang, peraturan, arahan, perintah pengadilan, undang-undang kecil, panduan, pekeliling atau kod yang terpakai untuk kami;

(cc) untuk menegakkan atau mempertahankan hak kami dan hak anda di bawah, dan untuk mematuhi, kewajiban kami berdasarkan undang-undang, perundangan dan peraturan yang dimeterai dengan kami;

(dd) untuk melakukan verifikasi dan pemeriksaan latar belakang sebagai bahagian dari setiap proses pengambilan dan pemilihan sehubungan dengan permohonan anda untuk bekerja dengan kami; dan / atau

(ee) untuk tujuan lain yang diperlukan untuk mengendalikan, mengekalkan dan mengurus perniagaan kami dengan lebih baik dan apa-apa hubungan antara kami, yang kami maklumkan kepada anda pada masa mendapat persetujuan anda; dan anda bersetuju dan memberi persetujuan kepada kami untuk menggunakan dan memproses data peribadi anda untuk tujuan tersebut sebagaimana yang dinyatakan dalam polisi Sekiranya anda tidak menyetujui kami memproses Data Peribadi anda untuk satu atau lebih Tujuan, sila maklumkan kepada kami di maklumat hubungan di bawah.

4. KESAN TIDAK BERSETUJU DENGAN DASAR INI

Pengumpulan Data Peribadi anda oleh kami mungkin bersifat wajib atau sukarela bergantung kepada Tujuan pengumpulan Data Peribadi anda. Sekiranya anda wajib memberikan Data Peribadi anda kepada kami, dan anda gagal atau memilih untuk tidak memberikan data tersebut kepada kami, atau tidak menyetujui perkara di atas atau Polisi ini, kami tidak akan dapat menyediakan produk dan / atau perkhidmatan atau berurusan dengan anda.

5. PENDEDAHAN DATA PERIBADI ANDA

Kami tidak akan menjual, menyewa, memindahkan atau mendedahkan sebarang Data Peribadi anda kepada pihak ketiga tanpa persetujuan anda. Walau bagaimanapun, kami mungkin mendedahkan Data Peribadi anda kepada pihak ketiga berikut, untuk satu atau lebih Tujuan di atas:

(a) syarikat dan sekutu kami yang berkaitan sama ada di Malaysia atau di luar negara;

(b) ahli keluarga terdekat anda dan / atau orang hubungan kecemasan yang mungkin diberitahu kepada kami dari semasa ke semasa;

(c) pengganti hak milik kami;

(d) mana-mana orang di bawah kewajipan kerahsiaan yang telah berjanji untuk menjaga kerahsiaan Data Peribadi anda yang telah kami ikuti untuk melaksanakan tanggungjawab kami kepada anda;

(e) mana-mana pihak yang berkaitan dengan prosiding undang-undang atau prospektif proses hukum;

(f) juruaudit kami, perunding, peguam, akauntan atau penasihat kewangan atau profesional lain yang dilantik berkaitan dengan perniagaan kami secara sulit, dilantik oleh kami untuk memberikan perkhidmatan kepada kami;

(g) mana-mana pihak yang dicalonkan atau dilantik oleh kami sama ada semata-mata atau bersama-sama dengan penyedia perkhidmatan lain, untuk tujuan mewujudkan dan mengekalkan pangkalan data bersama di mana kami mempunyai kepentingan bersama yang sah;

(h) pusat data dan / atau pelayan yang terletak di dalam atau di luar Malaysia untuk tujuan penyimpanan data atau sebaliknya;

(i) saluran pembayaran termasuk tetapi tidak terhad kepada institusi kewangan untuk tujuan menilai, mengesahkan, melaksanakan dan memfasilitasi pembayaran sejumlah amaun yang disebabkan oleh kami sehubungan dengan pembelian produk dan / atau perkhidmatan kami;

(j) badan pemerintah, badan penegak hukum, pengadilan, pengadilan, badan pengawas, pengatur industri, kementerian, dan / atau badan atau badan berkanun, pejabat atau perbandaran di mana-mana bidang kuasa, jika diperlukan atau diberi kuasa untuk melakukannya, untuk memenuhi hukum yang berlaku , peraturan, perintah atau penghakiman mahkamah atau pengadilan atau pertanyaan dari pihak berkuasa yang berkenaan;

(k) usaha sama / rakan niaga kami, penyedia produk dan / atau produk pihak ketiga, pembekal, vendor, kontraktor, pemproses data atau ejen, yang menyediakan produk dan / atau perkhidmatan yang berkaitan dengan perniagaan kami, atau melepaskan atau melaksanakannya atau lebih daripada Tujuan di atas dan tujuan lain yang diperlukan untuk mengendalikan dan mengekalkan perniagaan kami, termasuk tetapi tidak terhad kepada pusat panggilan, syarikat telekomunikasi, syarikat logistik, syarikat teknologi maklumat dan pusat data;

(l) syarikat insurans untuk tujuan menerapkan dan mendapatkan polisi insurans, jika perlu;

(m) institusi kewangan untuk tujuan memohon dan mendapatkan kemudahan kredit, jika perlu;

(n) institusi kewangan, pedagang dan organisasi kad kredit yang berkaitan dengan transaksi komersial anda dengan kami;

(o) orang awam apabila anda menjadi pemenang dalam peraduan dengan menerbitkan nama, gambar dan Data Peribadi anda yang lain tanpa pampasan untuk tujuan pengiklanan dan publisiti;

(p) kepada pelapor kredit pihak ketiga atau agensi pekerjaan sebagai sebahagian dari proses pengambilan dan pemilihan dan / atau sebaliknya sehubungan dengan permohonan anda untuk bekerja dengan kami;

(q) sekiranya terdapat penjualan, penjualan atau pelupusan perniagaan, kepentingan, penggabungan, pemerolehan, penyatuan, penyusunan semula, pelaksanaan pembiayaan atau penjualan aset yang berkaitan dengan kami, atau sekiranya berlaku penggulungan- ke atas (" Transaksi "), Data Peribadi anda mungkin diminta untuk diungkapkan atau dipindahkan ke pihak ketiga sebagai kesan dari, atau sehubungan dengan, Transaksi tersebut.

Anda dengan ini mengetahui bahawa pendedahan dan pemindahan tersebut mungkin berlaku dan membenarkan kami untuk mendedahkan dan memindahkan Data Peribadi anda kepada pihak ketiga tersebut dan penasihat / wakilnya dan / atau orang lain yang memerlukannya secara wajar agar kami dapat mengendalikan dan mengekalkan perniagaan kami atau menjalankan aktiviti yang dinyatakan dalam Tujuan.

6. KETEPATAN DATA PERIBADI ANDA

Kami berhasrat untuk memastikan semua Data Peribadi tepat, lengkap, tidak mengelirukan, terkini dan boleh dipercayai. Oleh itu, ketepatan Data Peribadi anda banyak bergantung pada maklumat yang anda berikan.

7. HAK ANDA

Tertakluk kepada pengecualian yang disediakan di bawah PDPA, anda berhak untuk meminta akses, meminta salinan, permintaan untuk mengemas kini atau membetulkan, Data Peribadi anda yang kami miliki. Kami mungkin mengenakan sedikit bayaran (jumlah yang dibenarkan oleh PDPA) untuk menampung kos pentadbiran yang terlibat dalam memproses permintaan anda untuk mengakses Data Peribadi anda.

8. PENYIMPANAN DATA PERIBADI ANDA

Sebarang Data Peribadi anda yang diberikan kepada kami disimpan selagi tujuan untuk mana Data Peribadi dikumpulkan berlanjutan; Data Peribadi anda kemudian dimusnahkan dari rekod dan sistem kami sesuai dengan dasar penyimpanan kami sekiranya Data Peribadi anda tidak lagi diperlukan untuk tujuan tersebut melainkan penyimpanan lebih lanjut diperlukan untuk memenuhi jangka masa penyimpanan yang lebih lama untuk memenuhi operasi, hukum kami, keperluan peraturan, cukai atau perakaunan.

9. KESELAMATAN DATA PERIBADI ANDA

9.1 Kami komited untuk memastikan bahawa Data Peribadi anda disimpan dengan selamat. Untuk mencegah akses, pengungkapan atau risiko lain yang tidak sah, kami berusaha , di mana mungkin, untuk menerapkan langkah-langkah keselamatan teknikal, fizikal, elektronik dan prosedur yang sesuai sesuai dengan undang-undang dan peraturan yang berlaku dan standard industri untuk melindungi dan mencegah yang tidak sah atau pemprosesan Data Peribadi anda yang tidak sah, dan pemusnahan, atau kehilangan, kerosakan, perubahan, pendedahan yang tidak dibenarkan atau akses ke Data Peribadi anda secara tidak sengaja .

10. PEMINDAHAN DATA PERIBADI ANDA DI LUAR MALAYSIA

Kemudahan dan pelayan penyimpanan teknologi maklumat kami mungkin terletak di wilayah lain di luar Malaysia. Ini mungkin termasuk, tetapi tidak terhad kepada, keadaan di mana Data Peribadi anda mungkin disimpan di pelayan yang berada di luar Malaysia. Di samping itu, Data Peribadi anda mungkin didedahkan atau dipindahkan ke entiti yang berada di luar Malaysia atau di mana anda mengakses Laman web dari negara-negara di luar Malaysia. Harap maklum bahawa entiti asing ini mungkin ditubuhkan di negara-negara yang mungkin tidak menawarkan tahap perlindungan data yang setara dengan yang ditawarkan di Malaysia berdasarkan undang-undang Malaysia. Anda dengan ini secara jelas memberi kebenaran kepada kami untuk memindahkan Data Peribadi anda ke luar Malaysia untuk tujuan tersebut. 11. LAMAN WEB

11.1 Pautan luaran

(a) Sekiranya mana-mana bahagian Laman web menghubungkan anda ke laman web lain, laman web tersebut tidak beroperasi di bawah Dasar ini dan kami tidak menerima tanggungjawab atau tanggungjawab yang timbul dari laman web tersebut.

12.2 KUKI

(a) Kami mungkin menggunakan teknologi standard industri yang disebut "cookies". Kuki adalah sebilangan kecil maklumat yang disimpan di cakera keras komputer atau peranti anda untuk tujuan penyimpanan rekod dan digunakan oleh kami untuk mengesan lawatan anda ke Laman web. 13. KONFLIK

Sekiranya terdapat percanggahan antara Dasar Privasi Data Peribadi bahasa Inggeris ini dan Dasar Privasi Data Peribadi Bahasa Malaysia yang sesuai, syarat-syarat dalam Dasar Privasi Data Peribadi bahasa Inggeris ini akan berlaku.
